Course Description

This course will teach students about the history, public policy considerations, and constitutional and statutory law surrounding the plea bargaining process. Topics covered will include (1) the intersection between the Brady doctrine and plea bargaining; (2) the admissibility of statements made during the plea bargaining process; (3) the right to the effective assistance during plea bargaining; (4) waivers of appellate rights; and (5) judicial participation in the plea bargaining process.Graduation Requirement: This course satisfies the perspective course graduation requirement.Basis of Grade: The grade will be based on class participation and a 12-15 page final research paper on some aspect of the plea bargaining process.Form of Grade: Letter.
